John,
you are almost certainly right, if the INVITE comes to Cisco without
REFER in the Allow: header it shouldn't use it. I can't point to an RFC
paragraph stating that because I didn't manage to find it within 5
minutes, but that's what UAs and B2BUAs commonly do, for example when
choosing UPDATE vs. INVITE for session refresh.
